Jakarta, bimasislam --- Ministry of Religious Affairs of Indonesia has issued Minister’s Regulation (PMA) concerning on Marital Records. PMA No. 19 Year 2018 is an improvement from PMA No. 11 Year 2007 concerning on Marriage Registration.
“There is a name change from the previous PMA regarding Marriage Registration to Marital Records. This is due to the adjustment of technical term,” explained the Secretary for Directorate General of Islamic Community Guidance (Ditjen Bimas), Tarmizi Tohor in Jakarta, Monday (09/17/2018).
According to him, this PMA regulates matters concerning on marital records, ranging from marriage will registration, announcement of marriage will, carrying out the marriage registrations, to submitting marriage registration books (in the form of electronic cards).
"This PMA will be the guideline for the Penghulu (Marriage Registration Officer) in carrying out marriage registration tasks," said Tarmizi.
This PMA also regulates new things. The conditions of the marriage guardian (Wali nikah) for example, in this PMA, marriage guardians are no longer measured by age, but only from the criteria of baligh (person who has reached maturity and has full responsibilities under the law). In PMA 11/2007, the guardian criteria are set based on age (at least 19 years)
Other matters regulated in this PMA include the marriage between a man and a Muslim woman must be recorded in the Marriage Certificate conducted by the KUA district. Marriage registration can be done after the marriage contract (akad nikah).
"After the marriage contract, the husband and wife get the Marriage Registration Book and the Marriage Card," explained Tarmizi.
According to Tarmizi, this PMA also regulates the Assistant Registrar of Marriage (P4), the development of a marriage management information system application, as well as provisions regarding marriage agreements. Additionally, PMA 19/2018 also regulates the registration of marriages of Indonesian citizens with foreigner (mixed marriage).
It was stated that a mixed marriage between a man and a Muslim woman with a different nationality and one of them was an Indonesian citizen, would be recorded in accordance with the provisions of the law. "The registration can be done at the KUA District or the Republic of Indonesia representative office abroad," he said.
In addition to mixed marriages, the recording of foreigner marriages can also be recorded at KUA Districts. The condition is that the marriage is conducted between Muslim foreigners.
"Marriage between Muslim foreigners can now be recorded in Indonesia," he added.
As for Indonesian citizens marriages abroad, this PMA regulates that it can be done at the RI Representative Office. The proof of marriage must be reported to KUA which located at the husband or wife residence no later than one year after returning to the country.
